Terms and Conditions

These are the terms and conditions we adhere to at Forge Ahead A/V Studios. To make sure we’re all on the same page and to avoid surprises later on, we ask our clients to read and agree to our Terms and Conditions when they book a session with us.

Forge Ahead A/V Studios is an affordable, full-service recording studio serving clients in the greater Atlanta area.

STUDIO TIME

The quoted rate includes use of all recording equipment, signal processing, most amplifiers, keyboards, and percussion instruments; guitars and some amplifiers are available for client use by special arrangement only. Studio rates include engineer unless prior arrangements have been made. These rates are for all multitrack recording, mixing, mastering, duplication, media backup, pre- and post-production work.

Daily lockout rate is based on a ten-hour workday. The workday is considered to begin at the scheduled start time of the session, and to end ten hours from that time. Overtime beyond the tenth hour is billed at the hourly book rate in minimum increments of 1/2 hour, except by prior arrangement with or at the discretion of Garrett. Note-all set up and tear down time is billed at full hourly rates except by prior arrangement with Garrett.

ENGINEERS

Our staff of house engineers have great ears, strong musical sensibilities, and know our facility inside and out. One of our engineers must be present at all sessions unless you are using an approved outside engineer or prior arrangements have been made with us.

MATERIALS

Master mixes, computer session files, analog and digital safeties and related materials remain the property of Forge Ahead A/V Studios until client balances are paid in full and until receipt of goods by client. Balances are due and payable on the day of the session and all accounts are c.o.d. unless other arrangements are made in advance with Forge Ahead A/V Studios.

BOOKINGS

Studio bookings are on a first call basis. Confirmed bookings will usually preempt time held without a deposit. Bookings are confirmed upon receipt of a deposit of 50% of the estimated cost of time, services and materials reserved. For bookings of two or more days, this 50% deposit must be received no later than 5 business days before the start date of the booking or the session may be subject to cancellation or rescheduling. Payments made online are considered paid according to the time stamp on the transaction. Sessions booked at discounted or special rates (i.e. less than current book rate) will be billed in minimum increments of one hour regardless of duration.

In the event of cancellation, client shall give Forge Ahead A/V Studios a minimum notice period greater than or equal to the period of studio time reserved under this agreement, or for a one-day booking a minimum of 48 hours (two business days). If notice is not given as described, 50% of the value of the total time will be charged. Cancellation must be made by direct voice contact with a representative of Forge Ahead A/V Studios, not via voicemail, email, written note or a third party. Any deposits made to hold studio time are non-refundable regardless of the time of cancellation.

PAYMENT

We accept the following forms of payment:

  • Cash (U.S. currency)
  • Credit cards (Visa, MC, Discover, Amex)
  • PayPal
  • Square
  • Cashier Check (in $U.S. drawn on a U.S. bank)
  • Corporate or personal check (by prior arrangement only)

All accounts are c.o.d. and payment in full for all services, facilities and materials supplied is due immediately upon completion of the work unless credit arrangements have been made in advance. On projects lasting longer than one week, charges will be posted and billed in weekly increments. Until payment in full and any accrued finance charges have been received, Forge Ahead A/V Studios shall retain exclusive possession and control of all recorded materials of the client. The client further agrees to pay all costs and expenses including actual legal fees incurred in the collection of any overdue accounts. Use of any recorded materials is prohibited until full payment has been made to Forge Ahead A/V Studios. Forge Ahead A/V Studios reserves the right to exercise its legal rights of control to prevent the use of or profit from recorded materials which have not been paid for. Any checks returned to Forge Ahead A/V Studios because of insufficient funds shall be subject to a service charge of $75.00. Rates quoted are exclusive of all applicable sales taxes.

PRO TOOLS AND OTHER SESSION FILES

Settings and techniques used within ProTools Session files are considered intellectual property and therefore master ProTools session files are not released by the studio unless there are special arrangements, made in advance. Raw multi-track audio and midi files are released on request, as long as all obligations have been honored. Cost for data transfers is at actual time required at the studio-with-engineer rate.

EXCLUSION OF LIABILITY

Forge Ahead A/V Studios recognizes the irreplaceable nature of the client’s materials and the performances contained thereon. It is hereby acknowledged by the client that neither Forge Ahead A/V Studios, nor its authorized agents or employees shall be responsible for any loss or damage, direct or consequential, caused to any magnetic recording tape, hard drives, or to any other physical devices used for the recording of sound or to any musical instruments or sound amplification equipment or instruments used or left on the premises of Forge Ahead A/V Studios, even if such damage is caused by negligence or other fault of Forge Ahead A/V Studios or its authorized agents. Any such materials or devices stored on the premises shall remain there at the sole risk of the client.

A special note about backups of digital materials: while Forge Ahead A/V Studios makes reasonable efforts to maintain backup copies of digital materials (e.g. computer disks/hard drives, DAT and DTRS tapes, CD-ROM’s, etc.) associated with current projects, client acknowledges its own sole and absolute responsibility to maintain backup/safety copies of such materials, entirely at its own expense and initiative. Client indemnifies and shall hold Forge Ahead A/V Studios blameless for any loss or damages resulting from failure to maintain backup copies of such materials, or from the malfunction of any storage devices or media. In no case shall Forge Ahead A/V Studios be responsible for the archiving of projects whether in progress or completed.

TERMINATION

Forge Ahead A/V Studios reserves the right, in its sole discretion, to terminate the Service, at any time, with or without notice. In the event of such termination, Forge Ahead A/V Studios will work with the Customer to determine the amount of any refund (if any) to be paid to the Customer as a result of such termination. Should the Customer’s use of the Service result from the Customer’s material breach of the terms and conditions of this Agreement, or any other agreement to which Forge Ahead A/V Studios and the Customer are a party, the Customer shall not be entitled to any refund, unless otherwise mutually agreed upon by the parties.

Forge Ahead A/V Studios reserves the right to modify, amend, update and change these Terms and Conditions from time to time with notice via email or other means. You are responsible for regularly viewing these Terms and Conditions. You acknowledge and agree that Forge Ahead A/V Studios shall not be liable to you or to any third party for any modification, amendment, suspension, discontinuance or other change to these Terms and Conditions.

ACCEPTANCE OF TERMS

By booking a session or securing any other services from Forge Ahead A/V Studios, you agree to the above terms and conditions. We suggest you print a copy of this document for your future reference.
